1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Gengency (“Gengency”, “we”, “us”) and govern your use of the Gengency mobile app, website and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
2. Eligibility and accounts
- You must be at least 13 years old, or the minimum age required in your country to use online services without parental consent if that is higher. If you are under 18 (or the age of majority where you live), you may only use the Service with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
- You must provide accurate information and keep your sign-in methods secure.
- Your account is for you alone. You’re responsible for activity that happens under it.
- You may not use the Service if you have been banned from it or are barred from doing so by law.
3. The Service
Gengency lets you record or upload a short video (4–30 seconds), describe the changes you want, and receive an AI-generated version of that video. Our AI analyzes your video frame by frame, transcribes what is said, and generates a proposed new look (for example outfit, background or props) for you to review. When you approve it, we generate the final video. The Service relies on third-party AI providers.
We’re constantly improving Gengency, so features, limits, AI models and availability may change. We may suspend the Service temporarily for maintenance or for reasons outside our control. We’ll try to give notice of significant changes where practical.
4. Your content
You keep ownership of the videos, audio, prompts and other material you submit (“Your Content”). To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, modify (including creating Generated Media from it) and display Your Content and Generated Media, solely to operate, provide, secure and improve the Service and as described in our Privacy Policy. This license ends when you delete the content or your account, except for copies kept for a limited time in backups or where the law requires us to keep them.
You confirm that you own or have all the rights, licenses and permissions needed for Your Content — including the consent of every person who appears or can be heard in your videos — and that Your Content and your use of the Service comply with these Terms and the law.
5. Generated media
“Generated Media” means the reference images, summaries, transcripts and videos the Service creates for you. As between you and Gengency, and to the extent permitted by law, you own the Generated Media created from Your Content, and we assign to you any rights we have in it. You may use it for any lawful purpose, subject to these Terms and the rights of others.
Because AI can produce similar results for different people, Generated Media may not be unique, and others may receive similar output. You are responsible for how you use and share Generated Media, including complying with laws and platform rules that require AI-generated or synthetic media to be labeled. Don’t present Generated Media as authentic, unaltered footage in a way that could deceive or harm others.
6. Acceptable use
You may not use the Service to upload, create or share content that:
- you don’t have the rights to use, or that infringes anyone’s copyright, trademark, privacy, publicity or other rights;
- is sexual or sexually explicit, contains nudity, or promotes sexual services;
- involves minors in any sexualized, exploitative, abusive or otherwise harmful way. We report child sexual abuse material to the National Center for Missing & Exploited Children and law enforcement;
- depicts or impersonates a real person without their consent — including public figures — or is designed to mislead people about what a real person said or did;
- features other people who haven’t agreed to appear in it or to have their likeness or voice transformed;
- harasses, bullies, threatens, defames or demeans anyone, or promotes hate or violence;
- promotes self-harm, terrorism or violent extremism;
- is illegal, promotes illegal activity, or is intended for fraud, scams or deceptive political content.
You also may not:
- try to bypass safety filters, usage limits or payment systems, or use bots or scripts to access the Service;
- reverse engineer, scrape, resell or sublicense the Service, except where the law allows;
- interfere with or disrupt the Service, or access other people’s accounts or data.
We and our providers use automated and manual checks to enforce these rules. We may refuse to process, block or remove content, and suspend or terminate accounts that break them. To report content or abuse, email support@gengency.app.
7. Tokens, subscriptions and payments
Tokens
- Generating videos uses tokens. One token covers about one second of source video (rounded up). The exact cost is shown in the app before you submit.
- Tokens are charged when you submit a video for generation.
- If a generation fails, the tokens are refunded to your balance automatically.
- Reviewing and tweaking the proposed look before you approve it is free, up to the limit shown in the app.
- Tokens don’t expire while your account exists. Any remaining tokens are lost when your account is deleted.
- Tokens are a limited license to use features of the Service. They have no cash value and can’t be sold, transferred or exchanged for money, except where the law requires.
- We may change how many tokens a generation costs in the future; the cost is always shown before you submit.
Subscriptions and auto-renewal
- Pro Weekly adds 15 tokens to your balance each weekly billing period. Pro Monthly adds 60 tokens each monthly billing period. Prices are shown in the app before you buy.
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
- Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel your subscription in your App Store or Google Play account settings at any time. Deleting the app or your Gengency account does not cancel your subscription.
- If you cancel, your subscription stays active until the end of the period you’ve paid for. Tokens you’ve already received stay in your balance.
- If we offer a free trial or introductory price, its terms are shown before you buy. Any unused part of a free trial ends when you purchase a subscription, where applicable.
- If prices change, you’ll be notified in line with App Store or Google Play rules.
Token packs
You can also buy one-time token packs (10, 30, 100 tokens). Packs are not subscriptions and do not renew.
Refunds
All purchases are processed by Apple or Google, and their refund policies apply. To request a refund, contact Apple (reportaproblem.apple.com) or Google Play. We can’t issue refunds for store purchases ourselves, but we’re happy to help — email support@gengency.app. Nothing in these Terms limits any refund rights you have under applicable consumer law.
8. About AI output
Gengency uses artificial intelligence, which is powerful but imperfect. Generated Media may contain errors or visual artifacts, may not perfectly preserve your likeness, motion or voice, and may differ from what you asked for. Summaries and transcripts may be inaccurate. That’s why you can review the look before the final render. Generated Media is provided for creative and entertainment purposes and isn’t professional advice of any kind. Please review it before you share it.
9. Our rights
The Service, including our software, design, brand and logos, belongs to Gengency and its licensors and is protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose under these Terms. If you send us feedback or ideas, we may use them without any obligation to you.
10. Copyright complaints
If you believe content on Gengency infringes your copyright, email support@gengency.app with: your contact details; a description of the copyrighted work; where the infringing material is (for example the relevant link); a statement that you have a good-faith belief the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We terminate the accounts of repeat infringers where appropriate.
11. Ending your account
You can stop using Gengency at any time and delete your account in the app under Settings → Delete account or via our account deletion page. We may suspend or terminate your access if you seriously or repeatedly break these Terms, if we’re required to by law, or if your use creates risk or legal exposure for us or others. Where reasonable, we’ll tell you why. Tokens remaining in an account terminated for serious or repeated violations may be forfeited, to the extent the law allows. Sections that by their nature should survive termination will survive.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free or secure. Some jurisdictions don’t allow these exclusions, so some may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Gengency will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or reputation, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US$50. Nothing in these Terms excludes liability that can’t be excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.
14. Indemnity
To the extent permitted by law, you agree to defend and indemnify Gengency against claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of Generated Media, or your breach of these Terms or of anyone’s rights.
15. Governing law and disputes
If you have a problem, please email support@gengency.app first — most issues can be solved quickly and informally, and we’ll try to resolve yours within 30 days. These Terms are governed by the laws of the jurisdiction where Gengency is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts.
16. Apple App Store terms
If you downloaded Gengency from the Apple App Store, the following also applies:
- These Terms are between you and Gengency, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Gengency, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to these Terms
We may update these Terms from time to time. We’ll change the effective date above and, for significant changes, notify you in the app or by email before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms.
